Weder Israel noch die USA sind Mitglied des ICC, dagegen hat Palästina seit 2015 den Status eines Mitgliedsstaates. Khan ist seit 2021 Chefankläger des ICC, eine Woche nachdem das Gericht bereits mehrheitlich beschlossen hatte, dass sich seine territoriale Zuständigkeit auf „Gaza und das Westjordanland“ erstreckt.”
