The Bochum doctor Dr. Andreas Triebel is one of thousands of doctors in Germany who
were and are being persecuted and harassed in many ways because they feel bound by their hypocratic oath and have also made the well-being of their patients the guideline for their actions in the course of the "corona measures". To ensure that they did not suffer serious damage to their health under the regime of the “rules” and could continue to cope with their everyday life, these doctors issued, for example, mask exemption certificates or vaccination exemptions in individual cases.

The restrictions began with the fact that, for the first time in history, medical certificates from medical laypersons were generally not recognized by the police, authorities and courts. This continued with systematic media defamation, threats of withdrawal of license and complaints, court proceedings, and raids by police troops in combat uniform and with unlocked weapons in surgeries and private rooms.

Especially when, like Dr. Andreas Triebel, a public political commitment was added, the "state power" in a number of cases with brutal force. Although contributions to public debates, information and the expression of opinions are a matter of course, even an indispensable necessity in democracies. Democracy cannot function without responsible citizens who get involved – especially if they also have the relevant expertise. In the case of Andreas Triebel, it was his membership in the new grassroots democratic party in Germany (die Basis), founded in 2020 in protest against an encroaching state and its excessive and dangerous measures. Above all, however, it was his speeches at demonstrations directed against disproportionate corona measures and restrictions on fundamental rights, in which he explained the medical background and pointed out dangerous misinformation from the media and state authorities.

What he publicly said there from the point of view of the family doctor and the responsible citizen not only corresponded to what democracies understand by the inalienable right to freedom of expression, it was also completely correct in terms of content. The technical correctness of the medical statements and warnings of Dr. Triebel and many other competent critics of the measures will hardly be disputed in 2023. The court proceedings brought against innocent citizens like Andreas Triebel in the years 2020 to 2022 are still going on in large numbers in 2023. Those affected continue to face severe penalties, and some are even in prison.

dr Andreas Triebel was acquitted of the charge of issuing incorrect health certificates (“mask certificates”) before the Bochum Regional Court. The public prosecutor's office has appealed, so his case is not over yet. The story of dr. Triebel uses a single example to show the abundance of social, political, legal, official and media abysses and scandals that have been justified with an alleged pandemic since 2020. For the base, Bochum city association, Michael Vogt and Dr. Andreas Triebel talked about how he's been handling events since 2020

the base BO:
Andreas, we are sitting here in the rooms of your practice, in one of the places where the events took place. What happened to you, your colleagues and patients here?

Andreas Triebel:
They just broke in here, messed around here and after a while they said: 'I'm from state security'. I always thought that as a citizen I was protecting the state - but he said he was protecting the state against me.

the base BO:
How did you get in, did you ring the bell?

Andreas Triebel:
No, such a practice is always open, and they broke in and barked at me that this was a search. Two of them were very young computer people who are
crashed straight to the server. First of all, I received these people in a friendly manner, I didn't know how that would turn out. And I didn't immediately understand that the whole thing was illegal and unlawful. So I invited them in and we sat down here and then they showed me the search warrant and it went on like this. And that a total of five times.

the base BO:
Five times?!

Andreas Triebel:
Yes, after the first time they probably said you have to find more and then they still didn't have enough. The judge, whom the public prosecutor had persuaded to sign it, should actually know that it is illegal. But he was told: We have found that Dr. Triebel issued certificates without an examination. That's totally out of the blue, but that was simply said. But of course they didn't find anything and then came back to maybe find something else - five times in all.

the base BO:
Was that somehow announced beforehand?

Andreas Triebel:
I was watched, they sneaked around my house and watched when I left the house. I then asked my lawyer whether I should take it seriously or whether I was imagining something, and she then wrote: 'You have to take this seriously'.

the base BO:
And the accusation was then?

Andreas Triebel:
I would have issued false certificates. Of course, I only issued correct certificates, but this accusation was the justification for violating fundamental rights and breaking the law. Because patient data, for example, is strictly protected, protected by the constitution. The intimacy and confidentiality of the conversation between doctor and patient is a core area of ​​fundamental rights protection, nobody is allowed to intrude there. But they have forcibly accepted it
took possession of these confidential documents without asking or informing either the patients or myself. And then they made it public, that's an outrageous breach of the law! It was read out publicly in court, the diagnoses with names, addresses and everything.

the base BO:
What did your lawyers say about that?

Andreas Triebel:
Of course they protested and pointed out that it was illegal, they also did it in writing, but they didn't get away with it. This is a criminal offense, this prosecutor is a criminal. But he can just keep going and hasn't been penalized. The judge who ordered the searches is also still in the district court.

the base BO:
What is the status of the process [March 2022]?

Andreas Triebel:
The prosecutor named about 20 witnesses [patients and employees] who should prove the allegations, so he probably thought that should be enough. But not a single one testified in his sense. You testified freely, openly and confidently - and the court had no choice but to acquit. The public prosecutor's office has appealed.
But now the public prosecutor had placed the proceedings right at the top of the list, not at the district court but at the same time at the regional court, with the press and so on. He probably wanted to send a signal: We have a doctor we can condemn. That backfired. However, the next instance is the Federal Court of Justice. So that's there now, but the prosecutor just repeated the allegations [in his appeal]. In my opinion, the BGH can now either say that this revision has no substance or turn to the numerous legal questions that arise here.

the base BO:
For you, the story has other sides besides the legal one. One of them is public display. To stay with the process, there was, for example, a report on the end of the process on WDR, which claimed that there were still some doubtful cases that were not the subject of the process. What do you say?

Andreas Triebel:
A marginal aspect is brought forward. In a process with six days of negotiations, many details are discussed. But that seems to me to be typical of current journalism: they don't talk about the essentials of the process, but rather bring up some marginal aspect in the hope that something might stick. But it was even worse, the WDR also reported incorrectly: I would have put pressure on the judge, that's not true at all.

the base BO:
In this WDR report there was also the accusation that you had advertised “mask certificates”.

Andreas Triebel:
You have to know the background to this: At the very beginning, a local SPD member of parliament claimed that a doctor in Bochum advertised on the Internet that he issued certificates without an examination. That was of course not true and was a slander – with the following background: This SPD member of parliament has a girlfriend who is the principal of a school in
hagen A mother with two children from this school was with me and I issued them mask exemption certificates. This rector was annoyed about this and asked her SPD friend to do something about it. – I'm not making that up now, it's in the files. This Mr. Rudolph then made a request to the state government in the state parliament - at that time under
Laschet - addressed what she intends to do against the doctor from Bochum, the certificates without
investigation issues. That was the start of the hunt. The next day, the WDR reported every hour about this inquiry in the state parliament, the WAZ had a big headline and the public prosecutor Bachmann gave interviews about what he was doing against this doctor. Shortly thereafter, the raids began
at me.

the base BO:
Was it also determined during the process that this accusation, which triggered the whole thing, is not true?

Andreas Triebel:
There is nothing there, that was Mr. Rudolph's invention.

the base BO:
What consequences did all this have for your practice, for you personally?

Andreas Triebel:
This had numerous consequences, which I cannot name all of them. For example, there are decades of relationships with patients. Everyone has now become unsettled and the old people in particular are not looking for a new doctor that easily. Especially with these older patients, a lot depends on the relationship with the doctor. And of course this relationship was partially disturbed. Then the agitation continued, the medical association suddenly demanded to see patient files. What right does the Medical Association have to inspect patient records? Zero, and they also know that they are not allowed to do that. Then the district government got involved, wanted to trick me - and finally issued a professional ban.

the base BO:
But what is it not allowed to do without a legally binding court decision?

Andreas Triebel:
Yes, with "danger im delay", I am a danger for the patients, that was the reason. We then went to court to get an urgent decision, but the court didn't react. It was clear that this had to be withdrawn, there was no evidence at all, there were only rumors and you can't just tell someone on the basis of rumours
revoke work permit. That has never happened before, but in "Corona times" it was just fine.

the base BO:
So the court delayed the decision?

Andreas Triebel:
Two months, and that's called an "urgent decision". If a practice is closed for two months - it's dead, then nothing works anymore.

the base BO:
How did you then solve it internally so that the practice continued?

Andreas Triebel:
I had an assistant who took over so that things would continue.

the base BO:
And the practice continues, maybe we need to keep that in mind.

Andreas Triebel:
Yes, it continues to exist, everything works as before.

the base BO:
Have you lost patients as a result of these events?

Andreas Triebel:
Yes, that's right, but overall not because others are now coming to me with great confidence who are disappointed in their previous doctors.

the base BO:
Keyword “imminent danger”: Let’s come to the medical side. What danger was there in default by issuing “mask certificates”?

Andreas Triebel:
For me, there was a risk for the patients in wearing the masks: If an asthmatic has to wear something like that, then he will have an asthma attack. He's not allowed to wear it, I even have to forbid it - I'm obliged to take care of his health. There are other serious cases that are not allowed to wear masks at all. That's how it is medically and I have to say that to the patients: They damage themselves.

the base BO:
What can this damage caused by wearing a mask be, for example?

Andreas Triebel:
Asthmatics can die from it and a heart patient who still wears a mask can have a heart attack, with all the consequences. He can also fall over if he gets dizzy, hitting his head hard and seriously injuring himself.

the base BO:
And what triggers the masks?

Andreas Triebel:
The CO2 in the breathing air increases and there is a lack of oxygen. It has a very different effect, some people can take it well, others not, people are very different. But those who are ill can certainly not stand it.

the base BO:
Is that just you saying that or is that medical standard?

Andreas Triebel:
That's medical standard, but many doctors don't dare to say it because they'll be ostracized.

the base BO:
Maybe you have to ask yourself: How would it have been “before Corona”?

Andreas Triebel:
Before Corona there were occupational safety guidelines. When working with heavy dust or with asbestos, you have to wear a mask for half an hour or so and then you have to take a break. The workers have to be examined by a company doctor to see if they are even able to endure it.

the base BO:
How was it with your school children, how long did they have to wear the mask at school? And what problems did they complain about?

Andreas Triebel:
They had to wear the mask on the school bus in the morning and then continue to wear it in class. They sometimes had to wear the masks from morning to night - of course not every child can endure that. They even sometimes had to wear the masks during sports, which is really unbelievable. Most have received damage, mental and physical damage. The teachers' associations
behaved irresponsibly by pushing it publicly on television. There is still a lot to be done in society.

the base BO:
What are the most important or most common damages?

Andreas Triebel:
The brain works differently when there is a lack of oxygen, concentration decreases, headaches and dizziness occur - very often even, growth slows down. We don't know if the damage is permanent, we'll only see that over time. But it is as clear as day that the damage is there.

the base BO:
"Mask certificates" are a new, a "corona" phenomenon, but certificates, certificates of incapacity for work, for example, have always existed. Have you or your colleagues ever had comparable problems and doubts about correctness?

Andreas Triebel:
No, I do not know such problems at all. Zero. The public prosecutor tried to prove something based on the date on the certificates, but everything was correct there. Incapacity for work is sometimes certified retrospectively, but that's okay too, you can't always
get to the doctor immediately. But there is always a date of the signature, i.e. unable to work from then and then and then the date of the signature. With the mask certificates there is only one date, that of the signature. That was then turned back and forth in the process, but that didn't change the fact that everything was correct.

the base BO:
Now there was the official reason why the masks had to be worn, namely to protect against respiratory infections. Is that true, can masks do that or is that nonsense?

Andreas Triebel:
There have been flu epidemics as long as there have been people, sometimes more intense, sometimes less intense. The epidemics of 2020 and 2021 were of medium intensity. In 2018 there was a much stronger flu epidemic, with many fatalities. Masks do not change these intensities, never have. There was even a discussion and investigation about it once and the WHO said back when it was still an independent organization: No, we do not recommend masks, they do not prevent the spread of flu.

the base BO:
How long have you been a practicing doctor, how much experience do you have there - and have there ever been problems with the medical association or authorities?

Andreas Triebel:
I've been doing this since 1982 and there have never been any problems, on the contrary: I often worked closely with the municipal authorities here, the mayor and others were my patients.

the base BO:
How did you become a “dangerous troublemaker” from one day to the next?

Andreas Triebel:
The health-threatening measures went very quickly: the lockdowns, the masks, what was happening was no longer normal, the level of fear rose more and more. I resisted this from the start, and as this increased more and more, my resistance also increased more and more. And then the groups formed, demonstrations took place, the party was founded, and I got involved straight away. Of course, that was ultimately the main reason why I was so much the focus of attention.

the base BO:
It can be observed that colleagues who have also issued mask certificates, but
were not so present in public, were rather left alone?

Andreas Triebel:
At the beginning there were a lot of doctors who issued certificates, but then often stopped doing it because they were afraid. There were very few left, to which I
belonged. Not all of them made public appearances, but they were also persecuted, in Leverkusen for example
example, a colleague is in prison.
Doctors are being prosecuted throughout Germany, the courts are involved on the government level, we don't get all of it, not even through the alternative media. I have to smile now when they show pictures on TV about how bad things are with Lukashenko or Putin or elsewhere.

the base BO:
Overall, how can it be that so many of your medical colleagues generally
Standard medical knowledge, e.g. on infectious diseases, apparently lost in the course of the "pandemic"
have eaten?

Andreas Triebel:
You have to differentiate: Some of them just blindly follow what the government prescribes and then there are many doctors who just kept their mouths shut. They knew what was happening to them, they didn't want seven armed police officers suddenly standing in their office. Word got around quickly about what happens to doctors who open their mouths.
