An urgent suspicion presupposes that a criminal offense has been committed in most cases, according to lawyer Dr. Alexander Christ, spokesman for the defense team. Even charitable associations are allowed to grant donations as loans, it is completely incomprehensible how one would want to construct a criminal liability from such a process. In particular, it should be taken into account that the company of the accused Michael Ballweg bought and made available three times the amount of necessary technology. The loan was only intended to partially cover these expenses. The district court in Stuttgart is now accusing Ballweg of not having invoiced this €210.000 so far.
Furthermore, the regional court did not take into account the argument of the defense that a large number of helpers is required for the preparation, implementation and follow-up of large-scale demonstrations. All of these helpers, around 30 - 40 people a day, were busy for about three months preparing for the demonstrations on August 01st, 2020, August 29th, 2020 and August 01st, 2021, and were not paid for their work by Michael Ballweg, but they were fed, for example. This alone cost several tens of thousands of euros. The regional court simply ignored the relevant lecture and did not question any of the named witnesses.
The defense pointed out that there is no obligation to provide documentation for donations. For many expenses, some of which had to be made at very short notice, there is understandably a lack of receipts. For example, power generators had to be procured, fiber optic cables laid through the Tiergarten in Berlin, and a large lifting platform with a camera was procured that took aerial photographs of the demonstration on August 29, 2020. Many of these expenses have been settled in cash on site. It is undisputed that this technology was available, the payment runs can be proven by witnesses. The district court has nevertheless refused to hear relevant witnesses.
The completely incomprehensible thing about this procedure is that Michael Ballweg is accused by the public prosecutor's office and the district court that he should not have used the money he received entirely for lateral thinking purposes, according to Dr. Christian. In fact, according to the current decision of the district court, it is undisputed that Ballweg has spent more than one million euros on the lateral thinking movement. He is said to have given a further €104.000 as a loan, and allegedly no receipts can be found for €145.000.
Would the district court take into account that Michael Ballweg bought hardware and software for €211.000 through his company media access exclusively for the movement, that he fed helpers for several tens of thousands of euros or paid their travel expenses, as is usual with volunteer helpers, or that expenses have been proven, only receipts are missing, then it would be obvious that the founder of lateral thinking put several hundred thousand euros from his own fortune into the movement.
According to the regional court, the public prosecutor's office should now ask the donors for which purposes they gave money to Ballweg. Michael Ballweg will, according to lawyer Dr. Christ, now held in custody so that the public prosecutor's office can collect possible exculpatory evidence. Because every so-called gift of thanks must be deducted from the collected amount of around 1,3 million euros. Only for the remaining amount would it then have to be checked whether Ballweg would have used it for a specific purpose. However, since earmarked expenditure of more than 1,5 million euros, i.e. two hundred thousand euros more than was donated, can be proven as appropriate expenditure by Ballweg, this measure appears to be purely arbitrary in order to be able to keep the founder of a movement critical of the measures in prison. It is from Dr. Christ completely disproportionate and a purely arbitrary measure of an encroaching judiciary to continue to deprive Michael Ballweg of his freedom. From the point of view of the defense team, there is still not the slightest factual evidence for this measure, let alone reliable evidence. The defense vehemently contradicts the view of the judges, according to which there is even a rudimentary suspicion of a crime.
The defense is now examining whether further complaints should be filed with the Higher Regional Court and whether the UN Human Rights Council should be informed about the imprisonment of a political opponent in order to start investigations against the Federal Republic of Germany.
